Retail Sale ("Purchaser") License Agreement

A "Retail Purchaser" / Reseller agrees and understands that:

1. Definitions:
   A "Retail Purchaser" is defined as someone who has purchase or otherwise been provided a copy of The-eBiz-eBook from a licensed reseller, but who has NOT purchased a branded copy upgrade license. (Options for such upgrades will follow below this section)
    

2. Suggested List Price:
   The minimum suggested list price for The-eBiz-eBook is $19.95 (But feel free to charge up to $29.95 or more if you'd like)
    

3. Licensed Not Sold:
   This product is licensed and not sold. As such a "retail purchaser" agrees to the following. If they do not agree to the following, they agree to destroy any and all copies of The-eBiz-eBook that they have in their possession.
    

4. Registration and Contact:
   Purchasers are required to register their copy, along with their email address and agree to accept a "welcome" email from the author, as well as follow up emails of specific interest to owners / resellers  of The-eBiz-eBook. Purchaser's / resellers may also be subscribed to The-eBiz-Journal, an ezine provided by the author. They understand that such emails may contain information about The-eBiz-eBook, as well as links or references to 3rd party products, offers and/or affiliate programs. They understand an "unsubscribe" link will be included in any such emails and that such requests will be honored to the best of our technical ability.
    

5. Vendor Liability Limits:
   They understand that this is a resalable product and that Havillah Road Enterprises is responsible ONLY for products sold directly by them. Thus, any sales issues or refund requests need to be directed to the person / reseller who actually sold the product.
    

6. "Use" & Backup Copies:
   They have the right to retain 2 copies of The-eBiz-eBook in their possession. (One for their "use" and one as a backup copy).
    

7. "Retail Purchaser" Resale Rights, Responsibilities & Limitations:
   
   A "Retail Purchaser" is given Resale Rights to The-eBiz-eBook. These rights include the right to make copies of their "use" copy for resale purposes. Should they choose this right to resell such copies, they also understand and agree that:
    

   1. They have the right to keep 100% of any of those direct sales revenues.
       

   2. They only have the right to "Sell" such copies alone (i.e. they do NOT have "giveaway rights", nor the rights to offer the product as a "bonus" product or as part of a product "bundle" with other products).
       

   3. They will clearly and obviously notify their customers of this purchaser / reseller agreement.
       

   4. They agree to offer and honor a minimum 30 day 100% money back guarantee and that this shall be the whole and total extent of any liability offered or expected of any reseller.
       

   5. Resale rights are included to those who purchase a from them as well, provided that the purchase also agrees to this contract.
       

   6. They agree to display the suggested retail price of $19.95 on any promotional materials they use for such sales.
       

   7. They may NOT promote such sales via online auctions sites such as eBay, but ONLY via there own website, ezine or other avenue they own themselves.
       

8. "Branded Copy" Resellers

   1. A branded copy reseller agrees to the same as the above (for a "Retails Copy" reseller) EXCEPT... They also have the right to use "their" branded copy as a "giveaway" or "bonus" product as well.
       

9. Guarantee:
   All "Retail Purchase's" of The-eBiz-eBook shall be backed by a 100% money back guarantee. Noting that:
    

   • The honoring of this guarantee shall be the sole responsibility and liability of the reseller.

   • The time limit of this guarantee shall be set by the individual reseller of this product (but shall not be set less than 30 days or as otherwise required by law).

   • It is understood that this guarantee applies to retail purchases only.

   • This refund policy shall be considered complete and total liability of the reseller and/or the author or his assigns for any dissatisfaction or damage claims associated with this product.
      

10. Potential Earning Disclaimer:
    While The-eBiz-eBook discusses ways that you can develop significant income online, the purchaser clearly understands that there are No Guarantees whatsoever, neither expressed nor implied, as to how much, or even if any, income may or may not be made using the ideas expressed in The-eBiz-eBook. This includes any and all income generated by the use of it's content & ideas, as well as any income generated from resale's of this product.
     

11. Upgrade Option Notification:
    While a "Retail Purchaser" is NOT obligated to purchase an upgrade to an affiliate link branded, they remember that such an option is available to them. Since the brandable version is an upgrade option, it can only be purchased from the "upgrade now" links found within The-eBiz-eBook.
